So a judge issued a court order for return of a firearm to someone prohibited from possessing a firearm due to probation laws in NC.  Person picked it up from sheriff's office and has it now.

What happens now??

Courts issue illegal orders all the time.

Usually the PD's cover their asses by sending the gun to a dealer for transfer.  If the person fails the BGC that's not their problem.

As soon as person exits the court, they are back in the public arena and are arrested for felon in possession.

We rarely do. The PD does the background check and releases the gun.

The courts routinely give us orders to do something illegal. The last time I offered to give the judge the firearm and let her commit the felony. She said no. I told her it would really help with her street cred, when she gets arrested for the felony!
