This morning as I was getting of the bus at Kent State University, I slipped on ice and broke my leg.  Doctors said I broke my fibia and dislocated my ankle. Waiting on the X-rays to get back to my house (family picking them up). Waiting on the VA to authorize going to a specialist because I might need surgery.  Some people are saying to get an accident lawyer.  I have no idea what to do. I know I won't be able to go back to work anytime soon and I don't know how I am going to do class.

Please help hive, I don't want to get fucked here.

Thanks.

Insurance should cover the leg.

FMLA will cover your job for up to 12 weeks I think (it uses your paid leave then it will be unpaid).

You can buy Aflac (I think?) to cover future accidents.

I'm not sure who you're wanting to sue so you might want to figure that out before you get a lawyer.

It's not so much of wanting to sue anyone. I want their insurance to cover the medical expenses and I need to figure something out about not being able to work.

The ambo said they couldn't take me to the VA so I am in the process of trying to get them to approve going to see the surgeon.

Who do you think is responsible for your broken leg and why?

You didn't give many details but it sounds like you broke your leg.

Isn't that what you have health insurance for, to cover your health expenses?  Or do you want them to pay for any copays/deductibles/out-of-pocket expense?

If you look up the Ohio Court of Claim's website and flip through their cases, you'll see a handful of lawsuits dealing with broken limbs after falling so you can see just how often schools pay out for something like this.

What did they do wrong, that makes you think it is their fault & they should pick up tab?

Yes, who could possibly be at fault here? Bus or frozen ground? I don't understand who you could have a case against.

Seek responsibility, and take responsibility for your actions.

Mother nature doesn't lose lawsuits often.

What footwear were you wearing and was it appropriate for ice?

Shit happens.  Nobody's at fault.

Yes, I am curious who you want to sue

Your health insurance will cover you.  They will probably also send you a form about the incident, asking about the circumstances, where it happened, etc.  Your insurance company will then decide whether or not to sue the university's insurance company.

Damn, Doug, I'm really sorry to hear this.

I hope you recover completely, and soon.

Contact your professors at KSU and tell them what happened. There may be a temporary remote-learning option they can offer you, or maybe email assignments to you. When I was an undergrad one of my classmates was similarly laid up for a while, but there was no email back then

Somebody had to bring the hardcopy lessons and assignments to him

Good luck!

So, when you use gravity and friction, who do you serve papers to?

I did a slip and fall with a tib/fib break at the ankle.  I did not want to sue the hotel and their insurance was pretty okay to deal with.  They paid my insurance deductible, lost wages etc. when I thought I was done after about 6 months I signed a waiver saying all was good.

Mistake!  About a month after that MY insurance company said that since I signed the disclaimer I was liable for all the medical bills!  Luckily they settled for what I deamed a reasonable amount and it was taken care of.

So... Hopefully my lesson can be of value to others.

Yeah you can get in trouble if you release your insurer's subrogation rights, that's a big hassle now.

They are supposed to notify you of the lien though.
