Ray,
Thank you for your recent e-mail to ATF.
In regards to your question whether you can legally install a
"pre-1981" auto sear into an AR-15 rifle, ATF Ruling 81-4 held that the
auto sear known by various trade names including "AR15 Auto Sear," "Drop
In Auto Sear," and "Auto Sear II," is a machinegun as defined by the
National Firearms Act. This ruling was applied to auto sears manufactured
on or after November 1, 1981. In 1986, Federal law changed and imposed
further restrictions on the possession of machineguns, generally
prohibiting individual possession. Thus, while a "pre-1981" auto sear is
not a machinegun, it's use now with an AR-15 type rifle is restricted to
that by a government agency. An individual can not acquire one and
install it legally.
For further questions, you can contact the National Firearms Act
Branch at (202) 927-8330 during the hours of 8:00 a.m. and 5:00 p.m.
(Eastern Time) Monday through Friday (Except Federal holidays).
