There have been some hotly debated threads about "con con" constitutional convention or similarly referred to Article V processes to change the constitution with some blurry and vague process where we allow politicians to rewrite the constitution.

I've long argued against it because of the liberal lefts control and desire to use it to take away even more of our rights.

Well we now see Californian's going to try to use to rewrite the constitution to be able to exit the union.

Mark Levin the radio talk show host is one of the biggest advocates of this process... as are many members here.

Will this change their minds? Will this make them understand how horrible of an idea it is now?

We shall see..

Also, no. I think that Mark Levin would probably be perfectly fine with states deciding to leave the United States and go it alone if they up and decided to do so.

I have to agree.
And no I do not want any states seceding from the union, its been tried already and didn't go well once. Instead we need to stop dicking around and begin punishing those that knowingly break the law or incite others to break the laws of our nation and they should be punished to the fullest extent of the law regardless if they hold elected office or not.

A convention of states is not a blank check to rewrite the constitution. It would end up being a line by line adoption process of the amendments purposed similar to the original method of how the constitution was written and adopted. Read a book. The 2nd will be as fine as it is now.

A mechanism for states to leave the union is one of the areas the founders left horribly lacking. It caused a war once and will do so again if nothing is done about it. If California left the union it would be a blessing. To be clear though I only support leaving on a county by county basis. If half of the geographical state wants to stay they can.

The Convention formed to Fix the Articles of Confederation had rules and the committee members decided to throw those out the window and came up with the Constitution instead.

Article V only provides a separate path for the proposal of Constitutional Amendments. A minority of States can no more impose changes to the Constitution (without 3/4 of the States ratifying the Amendment) than the Congress can.

One Supreme Court Justice (breaking a tie). . . .well that is a different story.

I'll say the same thing I always say in these threads. If and its a big if, an Article V convention is successfully "hijacked" and 3/4 States agree. Then guess what, the process was followed and the country as we hope it is, is dead.

Consider it a definitive sign that the USA is dead. So hem and haw all you want, just understand that it would be proof positive that the average citizen has no say in their governance.

Whatever California comes up with, it will no doubt fail to be passed by 3/4 of the states for ratification.  However, I'm sure Moonbeam and Pelosi will believe it does not need to be ratified.  If they lose that battle, they will fall back to popular vote rather than state ratification.

Why it will never be ratified?  It's because California will only be able to succeed if they get to discharge their debt.  That means the rest of the states would have to assume it.

You are mistaken. While there are a ton of opinion pieces written on it.... the Cogressional Research Office concluded that since there is no clear cut process in place then most of the process once it starts will have to made up along the way by the participants. So the whole "but they can't change (insert your personal favorite)" doesn't hold water in the argument.

You should read read up on it as well and stop being so reliant on the interwebs experts.

The Congressional Research Office disagrees with you. Their own report basically states that since there is no clear process for the Article V that much of it will have to be made up along the way by the participants.

I know a lot of the proponents like to think it is limited.... but it isn't. Scary stuff.

Stop with the scare tactics. Any amendment or change would have to be debated thoroughly and ratified by a super majority of states. Don't forget the shitheads in congress will have nothing to do with this process.

It would be awesome if California left the union for a while.  Democrats would never win another national election.  But it'll never happen - they just want to use the threat to get something.  But the proposal makes me support a constitutional convention even more - let them try to add a succession amendment.  If 3/4 of the states ratify a terrible amendment then we're already screwed anyway.  There is zero chance 3/4 of the states will ratify rescinding the 2A.

Article V convention will not happen. Congress will not allow it, they will disregard the outcome.  SCOTUS will declare process "Unconstitutional" and overturn any amendments.

Why don't you read a book?  That is precisely what we are afraid of, the first convention was supposed to be a line by line fixing of the Articles of Confederation, instead the Articles were dropped entirely and they started from scratch, and those were the Founders themselves.  Do you really think the modern left will follow the rules or intent?  Do you think they will pass up the chance to shred the Constitution?  The democrats are lockstep commie fucks, and the Republicans are ballless jokes and RINOs that will just give the democrats whatever they want with nothing in return in the name of "compromise."  Are these really the people you want rewriting the constitution?

By the time they are done we will no longer have equal representation, the senate will effectively be elimated and the liberal populous states will dominate and the other states will basically have no vote.  The electoral college will be gone and we will be voting over the internet with same day registration and no verification of any kind.  Abortion on demand and "alternative lifestyles" will be directly constitutionally protected and will be mandatory to be pushed in schools.  Home and private school will be illegal.  Healthcare will be nationalized and single payer, private healthcare will be illegal.  Guns will be banned completely.  Citizenship will be instantly granted, no questions asked, to anyone who wants it, even if they haven't even crossed the border yet.  Military control will be turned over to the UN.  You get the idea, we will look like Stalinist Russia by the time they are done.

A convention of states is not a blank check to rewrite the constitution. It would end up being a line by line adoption process of the amendments purposed similar to the original method of how the constitution was written and adopted. Read a book. The 2nd will be as fine as it is now.

A mechanism for states to leave the union is one of the areas the founders left horribly lacking. It caused a war once and will do so again if nothing is done about it. If California left the union it would be a blessing. To be clear though I only support leaving on a county by county basis. If half of the geographical state wants to stay they can.

States leaving the union is already constitutional.  Just because Lincoln started a war over it last time does nothing to change that fact.

regardless, as much as I hate socialists, preservation of the union should be paramount and the United States should not let CA leave.


EDIT: to @S_A_C 's point - agreed, our current elected officials have none of the moral character and commitment to ideals the founders had, which led to the creation and endurance of this great Republic.

What makes you say that?  They would have zero checks on their power, they could even vote themselves jobs for life, so no reelection.
What makes you think it would even be 3/4s?  A convention has no rules, they could make it a simple majority, or even no majoirity if they wanted too.

My prediction is that the high population leftist states will complain that it's "not fair" that they are outnumbered and refuse to vote on any amendment unless the rules are changed to allow them "equal" representation in some way.  I.E. California and New York run the convention.

It was the Founders, as you said. So whats you're point, the Founders were a bunch of hypocrites and the USC is illegitimate? We ignore the failures of the AoC, the inter-State trade wars, the common sentiment by the same Founders that their needed to be a change.  Start a revolution, win the revolution, form a government, make treaties with other nations, but the second form of government was just a step too much?

If an Art V is hijacked and turned against us, then frankly the left has total control of the country currently. You are currently alive by their grace, because it is not expedient to remove you yet. Allowing you to live serves their political purpose.
We are all alive under their created illusion, the illusion that we, the citizens have a say in our governance.

The irony of your position. You hold the Founders as the ideal, some even raised the same concerns you did. While you're here saying no, they revolted. While you are afraid to risk your remaining liberties, safe in what little still remains; they said enough. No more to the vacillations and vagaries of the King and Parliament, and here you are, deigning yourself and your Natural Rights to the whims and desires of those that would oppress all of us.

Maybe but the delegates can be recalled by their states if they go off the rails and the states have to ratify any changes.

At this point with the corruption we're seeing I say go for it.  Either we'll get some improvements that return some power to the states and hopefully term limits or it'll get worse.

It's going to get worse anyway so I'm not seeing the harm.  If they want to hit the accelerator and head for the cliff then bring it on.
