If true as reported, homeowner announced twice he was armed, and subject needed to identify himself.
"Vic" keeping his mouth shut and running out of a closet at a man who just said he was armed was probably not the best choice. Where was the daughter during the "I've got a gun" part? |

It is possible he knew his daughter had an older boyfriend yet didn't know what was happening right then. |

What facts were KNOWN to him at the time? What was reasonable for him to believe? Had daughter spoken up and then Dad shot then you have a different scenario. |

I've been in a very similar situation to this.
Wife and I went out on the town in DC, after getting a babysitter from our building. 14yr-old babysitter was in the shower when we got home about 2 hr later. She told my wife she had female problems, needed a shower. My radar was pinging bigtime that something was wrong. Babysitter takes her $20, see ya. Doesn't say anything. I check on the kids, who were all in one room since we were PCSing and had a bunch of crap packed in the other kids' bedroom. They were all sound asleep. I checked the room with everything packed in it. Immediate stench of dirty buttsex hit me, room was sweaty with funk, bloody condom on the windowsill, laundry baskets were broken and thrown aside on the floor. Skinny black kid was butt nekkid, hiding behind a crib, sweating and trembling. I carefully backed out of the room, retrieved my Glock 23, jacked the slide audibly with a live round going into battery. He went running around the apartment looking for his shoes, after hearing me chamber the round. Instead of bolting out the front door, he came back towards us in the hallway. I presented the muzzle to his face, without allowing him to get within trapping range, at which time his hands rocketed up in the air in hands-up fashion. "You dawg, dawg, she let me in dawg!" Me: "GET IN THE FRONT LEANING REST!" He gets down. I rack a round out onto the floor to roll around in front of him. Federal Hydra Shock .40 S&W. I told him he was a fraction of a second away from eating 2 of those to the chest and one to his face. I told him to get his gear and get out, which he did. I was literally about a half a pound away from Bill Drilling or Mozambiquing him. Turns out his single mother was away at BNCOC, and he was without supervision. He went around afterwards telling his friends that some crazy white guy pulled a gun on him. CID responded with an investigation, came to the apartment to interview me. After hearing what happened, CID agent tells me I was well within my rights to have blasted him to the face and chest, per VA law. I didn't want to discharge a .40 cal pistol in a tight hallway without ear pro, and had it under control, so taking a life wasn't necessary to me. |
