On that kind of motorcycle the stock set up is usually very flexible.  When it flexes and the suspension is compressed, the rear tire eats the plate.

I think I'd contact the manufacturer of the plate mount and explain what happened, they may well have to get some sort of DOT approval before they go on the market that would be a defense against this charge. See what they say, it's in their best interest that you not get found guilty.
