I was told by a US Marshall here in GA that I can drive 10 over legally. 11 over, ticket.

That is pretty much everywhere.  However, 90 in a 55 is 35 over the limit.  Some states that is reckless driving in and of itself.  Here you would be talking to a judge for anything over 20 to determine the fine, but it is still usually just speeding up to 40 over.  (reckless they have to prove you were a danger to the public)  35 over and kill two people, involuntary manslaughter charges are a possibility.

How long before the next thread saying speed limits are bullshit laws and set arbitrarily low to generate revenue?

In many cases they are way lower than they should be.  However, 90 on a non-limited access road in a somewhat built up area is a really bad idea.

A lot of you are forgetting that the other driver turned left in front of him.  And the two females who died were not wearing seatbelts.  I'm not saying the trooper is innocent, and his speed is a contributing factor in the severity of the accident, but he's not totally at fault.

ETA: I've worked accidents where I cited the at fault driver for failure to yield while turning left.  When one took it to court and argued that the oncoming car was speeding the judge said he didn't care if they were going 300mph and doing cartwheels, you still have to yield before you can make a left turn.

That judge is a loon.  At least you set it up by citing the drivers for something the human body isn't good at doing.  


Actually, the judge was right and YOU are the loon. If you turn left, you are responsible for yielding right-of-way to oncoming traffic, regardless of HOW fast they're going. LAW. LEARN IT.

Physics, real world practical application.
Learn it.

The actual limitations of the human body are of no concern when choosing what laws to enforce.

The trooper was coming around the curve at 90mph. It could be fairly easy to misjudge speed, especially at night on a curve, and think you have plenty of time to turn when you aren't expecting someone to be going 35mph faster than they are supposed to be going. The closing distance is nearly half what it should be.

This is not the correct intersection. It is the next intersection headed north on HWY 27 at the BP station. The road they were turning into is at the top of a rise as you are traveling on 27 and is natorious for wrecks and that you should approach it paying attention during a clear day but especially at night or during inclement weather. There have been many wrecks there several involving deaths over the years. The kids didn't pull in front of anyone the trooper was simply going way too fast for that area and it will end up costing him dearly. I live 2 miles from there and the impact this is having on the families of the kids and their friends is terrible. It is a great, close community one that this trooper is apart of and very well knew better than to be speeding in that area. Damn shame.



On another note. GA code says that city/county cops cannot write a valid ticket for under 10 over the speed limit. Gods Special Police can cite you for 1 over though.

However, GSP has publicly stated that they won't enforce for less than 10 over unless there are other circumstances justifying doing so.  In addition, there is no specified  fine in the law for speeding less than 15mph over the limit, so I've had a local attorney challenge me to find a case where the cops cited someone for less than 15 over.  What makes it fun is that Super Speeder kicks in at 85mph, no matter what the speed limit is... So 15 over in a 70mph zone...

 
This was maybe 9 years ago.

 
GSP pulled me over for going 72 in a 65 on a state highway.

Once the trooper saw my LE credentials (was a campus LEO then), told me to have a good day.

He never did tell me why he stopped me either.

My guess is that he thought it was a 55mph zone, which would have generated decent revenue.

And this happened during daylight on a clear day too.

2 counts.  Any other person would do some time in prison  but I am certain the GBI will keep his sorry ass out of jail.  At least he will never own anything again.  And for those who feel sorry for that trooper, fuck that guy he knew better, he had been disciplined twice and finally killed two girls.  He belongs in prison and I hope the lawsuit bankrupts him and devestates the GSP.

It's not even clear that this is what happened (teens "pulling out" in front of the cop). The article is somewhat ambiguous, it implies that they were doing 65 when or just before the collision occurred.

Either way, if you rear-end someone going 90mph, I don't see how anyone that isn't a sociopath can try to claim it was the other guy's fault.

It is indisputable that the burden is on a party making a left turn to ensure that he can do so without interfering with oncoming traffic.

It's also human physiology.  You can talk whatever indisputable things you want but arguing that people should do physically impossible things is beyond illogical.

So at night do you wait until its clear enough that the turn is clear at reasonable speeds for the road or on the one in a million chance that the car is doing 120?

It does, but it's actually an idiotically absolute rule. It theoretically means that if a drunk with no license runs a red light at 90mph and wipes out a car full of nuns, the nuns are barred from recovering a dime if they were going 1mph over the limit.

I thought the threshold was the same >20mph as the reckless statute.
