This is rather frustrating, as a main source of additional protein for me has been through their tuna. Along with protein powder supplements, I have eaten a whole lot of their tuna in the past six or seven years now. Have they been shorting me? I mean, a hundred or more cans a year easily...

But, see, what's happening is the government is forcing them to give me what I already paid for a number of years ago. I didn't buy 4.8 ounce cans of tuna, I bought 5 ounce cans. Just because I didn't notice the difference in weight doesn't mean I didn't pay for the missing tablespoon in each can. Free enterprise only works if both sides of the transaction are honest and forthright. Th government's role is ensuring that the injured party is made whole by the dishonest party. In this case, it is the court's role to tell Starkist to either cut a check or issue a voucher to each of the customers who were slighted. Is the manner in which Starkist doing so rife with opportunity for leeches to take advantage of the situation? Sure. But, their willingness to be dishonest in no way diminishes the fact that Starkist committed fraud and theft by deception.

Or, do you routinely allow those who screw you out of something you bought get away with it, regardless of the value? If you're okay with someone willfully taking from another through deception, I would argue that you're probably likely to take from others by deceiving them.

Besides, we're not talking about just "a few grams" of tuna. We're talking about a few grams of tuna multiplied by countless containers. Stealing $50 from you isn't okay just because they only took it a quarter at a time, especially when they did the same thing to hundreds of thousands, or millions, of people.

I've probably bought at least one can of 5 oz. Starkist tuna during that period.  But, I'm opting out, so I can pursue my own separate litigation on my own behalf.  

Nah, I just hate class action suits.  Especially about stupid sh*t like this.

Its a pro-rata settlement so maybe so many will opt-in that they will only get pennies on the dollar.  lol.

I'm torn on this.










I've purchased a ton of their product (usually chunk light in water).  I grew accustomed to making tuna salad out of two cans because one seemed dinky after being drained.  I think maybe I averaged four cans a month.  Big fan of the bulk packs.












But I hate lawyers and feel dirty signing up.

I don't know how much starkist I've bought during the time period but always noticed it was rather weird that the cans always seemed under-filled. Enough that you could slosh the tuna around and here it thump against the sides of the cans.

Based on the cans I have bought recently I thought the suit was going to be about low quality tuna. I've had a few cans in the last month with noticeable chunks of bone or scale in them. That, and LOTS that looked more like the tuna version of lean finely textured beef than "chunk light tuna". Very inconsistent QC on the Starkist line lately. I've been meaning to contact them about it, but it's nothing I was going to sue over.

I was one of those over seas guys like another poster mentioned getting it in care packages. My mom sent me that, rip off mom? Ill have her fill one out too.

I have a problem with businesses and persons whom lack ethics. A lot of people here will say F cheaper than dirt for being "gougers" but equate a small amount of compensation for theft on the tuna guys is FSA.

Their tuna went to hell ever since they stopped putting dolphin in with it.  They used to sell it in 6 oz. cans and then lowered it to 5 oz cans.  Ignorant people here bitching about people putting a claim in.  I buy the cans 20 at a time.  It says right on the can that it contains 4 ounces drained weight.  If they were only putting 2.35 ounces of tuna in the can then they were shorting everyone almost 42% of what the can advertises as the drained amount.

Air in the bag is irrelevant... they're sold by weight, not volume.  They could sell you four chips in a box the size of a semi, and as long as they were upfront about the weight of the chips you were purchasing, they're good to go.

On the other hand, if you bought a one-pound bag of chips and it only weighed 9 ounces, you'd probably be like ... which is basically what Starkist is accused of.

No, I don't keep track of my tuna. It's fairly easy, though, at least for an intelligent individual, to take the one can of tuna he buys a week for his family, multiply it by the 52 weeks in a year, further multiply it by the five years covered under the suit, and come to the conclusion that his family has most likely consumed at least 260 cans over that period. Then, you multiply that by the net weight of the can's contents (5 ounces) and multiply that by the amount the lawsuit contends the manufacturer was actually putting into the cans (82.7%) to arrive at the amount of product actually received versus the amount for which the customer paid. Then, you simply multiply the amount shorted by the price of the product and you arrive at an average amount of money the consumer lost because some thief at the manufacturer thought he'd have such low integrity as to defraud customers. I'm sorry they didn't teach math in whatever school you attended.

By your attitude of thinking wanting remuneration from a thief is akin to being a welfare leech, I can only deduce that you have a preference for thieves as opposed to those who've been wronged. I am also forced to believe that should you be discovered wronging someone, you would think they were wrong for demanding you make good on your wrongdoing. While you may not be a thief, you definitely display beliefs that support thieves. That alone would cause me to never trust you in any kind of business deal. You would rather the thief be left to their own devices, going unpunished, than see people who do buy from them receive compensation for five years worth of deception. You have no integrity, having replaced it with an holier-than-thou attitude.

As to your accusation that I am taking something for nothing, go fuck yourself. I know my grocery purchasing habits, not you. I've stated repeatedly in this thread that I buy at least a can of Starkist a week for my family, and have been buying it for long before the time frame of the lawsuit. (Oh, and, it's not government tuna. It's the tuna I paid for between 2009 and 2014, which they didn't give me when I paid for it. I know, that's likely too difficult a concept for you to wrap your head around, though.)

Starkist agreed to this without going to court.

Starkist KNOW they fucked up and would rather do this since they determined how much total $$$ they will pay. Most likely it is much lower than what they took in over those years, so it's a write off.
