Gorman filed a claim in federal court to get his money back, and in June, Larry Hicks, a U.S. district judge for the District of Nevada, ordered the government to return Gorman’s money. In his ruling, Hicks criticized the government for failing to disclose information related to Gorman’s second traffic stop, specifically that the first officer with Nevada Highway Patrol had instructed the Elk County Sheriff’s deputy to pull Gorman over again. Gorman was driving across the country with a motorhome to see his girlfriend, and a Nevada Highway Patrol trooper first stopped the man as he headed west on Interstate 80 for driving too slowly in the passing lane. According to court documents, Gorman didn’t consent to a search of his vehicle, but the trooper sent him on his way without issuing any citations.
Less than 50 minutes later, though, an officer with the Elko County Sheriff’s Office stopped Gorman again. On the second stop, the officer had a drug-sniffing dog with him, and law enforcement conducted a search of the motorhome, where he found $167,000 in cash stored throughout the vehicle. I'm all in favor of asset forfeiture.
After it's been proven beyond a reasonable doubt that it's presence is due to illegal activity, and not just that the presence itself is indicative of criminal activity. |

Too much information missing in the article. I cannot say the situation is fucky absent that info.
What crime did the citizen commit? What was he charged with? What citations did he receive? Indictments? Convictions, as a result of this stop? Ok, on review, sounds fucky to me. He should be made whole from pensions of all parties trying to screw him over. |

Good, I hope he gets his money back and his legal fees. There shouldn't`t be any qualified immunity in these cases for prosecutors or cops, and forfeiture shouldn`t occur until after a criminal conviction.

Iwish judges would order that people's stuff must be returned "before end of business day" to thwart such shenanigans. By the time they challenge the ruling the guy and his property is long gone.

(which covers most of Atlanta) is embroiled in yet another forfeiture scandal. As the Atlanta Journal-Constitution reported over the weekend, the office for Fulton County DA Paul Howard has spent thousands of dollars in federal forfeiture funds on all sorts of eyebrow-raising items.
Howard’s office has repeatedly spent thousands on soirées, including a holiday awards gala in 2010 where “guests dined on $3,200 worth of sirloin tip beef roast, roasted turkey breast and mini-crab cakes with champagne sauce.” Other lowlights include spending $250 on tickets to see NBA player Dwight Howard and rap artist CeeLo Green, $800 to pay off eviction fees, $1,100 on flowers, $5,600 on a Christmas party, and $1,000 on alcoholic drinks for another holiday party.
