Death Penalty Opinion.
Scalia is his usual self. Even accepting JUSTICE BREYER’s rewriting of the Eighth Amendment, his argument is full of internal contradictions and (it must be said) gobbledy-gook. He says that the death penalty is cruel because it is unreliable; but it is convictions, not punishments, that are unreliable. JUSTICE BREYER apparently forgets that one of the plaintiffs in this very case was already in prison when he committed the murder that landed him on death row. Indeed, for the past two decades, JUSTICE BREYER has been the Drum Major in this parade. His invocation of the resultant delay as grounds for abolishing the death penalty calls to mind the man sentenced to death for killing his parents, who pleads for mercy on the ground that he is an orphan. |

She won't retire unless she has some kind of major health event (worse than cancer) that would prevent her from attending oral arguments. I'd bet she'd like to see if HRC wins so a FEMALE POTUS can fill her seat -- remember WJC appointed her. If an R wins she'll just keep hanging on. |
