I think the ATF is more likely to lose this case than the Form 1 machinegun cases that will brought soon. They should have cut their losses.

If Sig just received the ATF findings recently it makes sense that they will need some time to compile a case against the crayon engineering needed to support the suppressor finding.
In golf its called a back swing. My bet is that the Sig muzzle brakes are going to be legal and for sale on Black Friday!!!

excerpt doc 10 (Sig Sauer amended motion) 23. In an undated letter from Earl Griffith, Chief, ATF Firearms Technology Branch, to
Sig Sauer, received by Sig Sauer on August 13, 2014, ATF reaffirmed its prior decision that the device “is intended only for use in the assembly or fabrication of a silencer and, therefore, is a ‘firearm silencer’ . . . .” 24. ATF conducted sound-meter testing and found that use of the Sig Sauer device “result[ed] in an increase of 2.41, 1.17, and 1.45 decibels to the side, front and rear of the firearm.” ATF Letter, p. 15. 25. ATF listed ten design characteristics, including household items like washers and steel wool, it believes are commonly found in conventional firearm silencers. Letter p. 4. ATF conceded that “a silencer may be produced from a conventional muzzle brake when other parts are added . . . .” Letter p. 9. 26. I look forward to sig winning this and an industry of "double threaded muzzle brakes" starting up because of it, where you buy the tax stamped metal sleeve for a nominal value, especially where they design it so the sleeve fits multiple caliber "muzzle brakes".
