New York has been using the Sullivan Act to confiscate firearms for over 100 years.

A lot don't, I know in Erie county Chris Jacobs the county clerk is very much against it, is part of a suit against the NYSP (or maybe a willing witness) due to some issues with it and the reality of a NYSP secret unit operating against gun owners, and our Sherrif, Tim Howard has been very vocal against it, ran for re-election this year flat out stating he would not enforce it (and I don't think there have been any arrests in Erie County by the Sheriffs Dept), and won..... Time will tell, but there is pushback. Of course even if 90% of upstate LE is against it, and won't enforce it, there is the 10% who will zealously enforce it.... |

If I had to take a WAG, I'd lean toward registration-via-background check but I'm totally ignorant of what the upstate laws and state requirements are. It would be only that - a guess. And, actually, I had a recent disagreement with my wife's uncle - an NYPD captain - about the very topic of being morally responsible for our actions, whether or not they are "legal". I had that fresh in my mind when I read the above. |
