Bakersfield man says Kern County sheriff deputies ‘tortured’ and jailed him before eventually releasing him without charge

For Kern County Sheriff’s Department, the accusations of brutality are beginning to pile up.



David Scott Byrket, a 53-year-old father of four with no criminal record, told the Daily News that on April 21, he was repeatedly beaten by sheriff’s deputies, stripped of his clothes and thrown into a jail cell, before suddenly being set free two days later with no charges filed against him.

They told me they were going to kill me,” Byrket, who goes by the name Scotty, said. “There were multiple officers involved, it was scary.”

Experiencing significant pain in his back and side, Byrket’s family took him to Bakersfield Memorial Hospital, where x-rays showed that he had suffered “multiple right-sided rib fractures.”

Days later, Byrket’s wife drove him to Loma Linda University Hospital, and a MRI revealed two fractures to the discs in his spine.

Armed with the medical information, Byrket wrote a letter to Kern County Sheriff Donny Youngblood on May 17 requesting a formal investigation of his treatment.

While tragic (if true) when I worked in prisons , some inmates wpuld injure themselves by dropping their body onto the toilet seat and kicking the doors and then claiming we beat them. (makes for a large inmate trust account to buy shit at the commissary while they're in prison if they win)

So not knowing all sides to this story, I'll reserve judgement.

But Wimbish also told Bakersfield TV station KGET that "he didn't have anything to do with it but that when he saw the decals he found out who was responsible and had them reprimanded."


The sergeant in charge of vehicles claimed he could not recall who told him to put the questionable decals on the cars (except that it was not Sheriff Wimbish), but then Assistant Sheriff Lafave said the sergeant had suddenly remembered that the commander in charge of vehicles told him to make up the stickers and place them on two patrol cars. The commander in charge of vehicles, Chris Davis, told KGET that "there never was a direct order to pull off this gag."

Short story.

1) Drunk son calls police on father with fake story about domestic abuse.
2) Police arrest dad.
3) Police administer roadside justice fracturing ribs and causing vertebral disc herniations.
4) Police cut dad loose after they realize their was no crime.
5) Complaint filed with Sheriff yet no Internal Affairs investigation is ever done.
6) Story ends up in Daily News.

I lived in Bakersfield also.   It happened.   The cars never hit the street with the logo, but pictures were taken and someone got ahold of them.    Wimbash said it would be funny and someone thought that ment put them on the cars.  

Rumor has it they also put "we'll bite your ass" on a K-9 unit.

2) $7M Settlement Against Kern County Sheriff's Dept.


The settlement covers former inmates who were strip-searched after having been ordered released by a court, and those who were strip-searched in a group without any privacy, White said.

We'll Kick Your Ass' Slogan on Sheriff's Patrol Cars Becomes Issue in Excessive Force Trial

They claim in a trial brief that the department's slogan shows that an "intent to do harm" is part of the department's culture.

Bakersfield attorney Andrew Thomson dismissed the charge. The slogans "were done in humor," he told jurors last week.



"It was an unfortunate attempt at public relations when it happened, and it was immediately renounced," Kern County spokesman Allan Krauter said. "That's certainly not the attitude the county wants to portray to the people whom it serves, and it's certainly not the attitude of the current sheriff."

In their trial brief, the Philips also say a Kern County Sheriff's Department K-9 car featured the slogan, "We'll Bite Your Ass."

Plus there is the medical issue. The Sheriff's department was responsible for his injuries yet did not provide him with medical attention. He sustained fractures and required spinal surgery. The man's health was the Sheriff's responsibility when he was in custody and they did not do their duty by "deliberate indifference to serious medical needs".

Also, a crime was committed by ignoring his medical needs.

California Penal Code Section 673 makes certain kinds of prisoner medical care neglect a misdemeanor crime.12
