MYOB would NEVER apply on a public roadway. A year and a half ago a co-worker of mine was rear-ended by a semi while he was stopped at a traffic light. The force of the collision pushed his SUV 500 feet from the point of impact. I was at work when we got the call from the hospital trying to contact his relatives. The nurse was FRANTIC on the phone. They couldn't find his wallet and the only reason they called us was because of his uniform shirt he was wearing had the company name on it. They were transferring him by helicopter to a larger hospital with a better trauma center. Unfortunately he died a week later, on Thanksgiving day. Nicest guy you would ever want to meet. The point of the above story is that since that day I NEVER give truckers the benefit of the doubt. I have called the police and company hot-lines dozens of times since then. If I see anything illegal or questionable, they are getting reported. Running red lights, dangerous speeding, tires going over the white lines, throwing stuff (piss bottles) out of windows, I've reported them all. |

Damn. I was expecting I-40 from Amarillo to Flagstaff or something. A dangerous two-lane road is nuts. I'd get a better shot and call it in.

I think you should wait until they kill someone, then call the news and tell them you saw them doing this for like a year.
Call the company and be honest with them. Tell them you aren't trying to get anyone in trouble but it sure looks like they are not driving with their full attention. Those big trucks can cause a massive amount of hurt in a blink of an eye. |

There was one a while back in another state where the truck driver was elderly and texting, killed a family in a minivan that he blasted from behind. Just takes a second. |

ED If he just saw her once this would be a totally different story but he sees this constantly implying that she isn't just doing some quick task like glancing at a short text or checking the time. She is paying attention to the device far too much if every time he sees her she is on it. I'm with the op. He should get better evidence then take it to the company. |

Use of any handheld device for CDL holders has been illegal since Jan 1st I believe,it's a big fine so I don't even take a chance.
I don't even look at my DIAD while driving. Would I turn in a fellow CDL,no it's not my job to do police work, just like it's not a cops job to do my deliveries and pickups..It should be illegal for EVERYONE to use a hand held device while driving. The amount of stupidity I see people do while talking or texting everyday amazes me. |

policy, whatever it is.Their safety dept would love to hear from you, and should. Thats 80,000 lbs of rolling death. |

Call it in, tell them exactly what you are seeing and for how long you have noticed it going on. Get the truck number off of the side of the truck. You can go here to get a phone number.

The new CSA laws that were passed back in 2010 make it illegal for any DOT truck driver to use an electronic device while driving. The TSA will fine the driver and then the company triple what they fined the driver if she is caught by dot. She is breaking federal law by doing this. I would call the company and let them know, as most companies now have no tolerance policies for using phones with out hand held devices, or no phones at all.
