Usually the drugs near a school is an enhanced charge that is a felony.

Pretty sure in Texas that those are felonies. I don't think that school thing applies to misdemeanors.

Hey 57 what are you going to have to sell because of this, I call dibs if its good stuff. Honestly I look at initial charges as a worse case scenario. If you spend the money on a good attorney they should be able to get it all knocked down. If this involves you personally I hate it for you, I hope you can beat it. I have never faced a situation like this and I do not envy you at all. Now if this is your daughter's boyfriend we are talking about, tell her to eject.

MDP DRUGS NEAR SCHOOL MDP OTHER IN SCH I,II,III 1ST Some drugs are worse to trade, made or possess illegally than others. According to Texas the classes are defined as follows: Schedule I — drugs with a high abuse risk. These drugs have NO safe, accepted medical use in the United States. Some examples are heroin, marijuana, LSD, PCP, and crack cocaine. Schedule II — drugs with a high abuse risk, but also have safe and accepted medical uses in the United States. These drugs can cause severe psychological or physical dependence. Example - morphine, Ritalin Schedule III, IV, or V — drugs with an abuse risk less than Schedule II. These drugs also have safe and accepted medical uses in the United States. Schedule III, IV, or V drugs include those containing smaller amounts of certain narcotic and non-narcotic drugs, anti-anxiety drugs, tranquilizers, sedatives, stimulants, and non-narcotic analgesics. Examples - Tylenol #3, Vicoden etc. The kicker however is the first charge - MDP DRUGS NEAR SCHOOL . It won't matter what class of drug you have - even a class V drug - if you're caught making, distributing, or possessing it illegally within 1000 feet of a school... you're fucked. |

could be misdemeanor drug possession around school, but with the second being schedule 1,2,3, I would go with felonies and what the above said.

Manufacture, distrribution, possession? likely this. In Michigan (and many other states) there are enhancements for Possesion with intent to distribute/sale with in so many feet of a school (Michigan is 1000ft). The other one with the schedules makes me think that is it a felony charge. J- |

The "1st" part is related to the degree, which should make it a 1st degree felony if I read that right. And it is possess, not procure.
Both huge charges. What county and any prior convictions or arrests will play a big role in the disposition of the case. |
