I am representing someone in a failure to notify case. It is an ongoing legal case, so I dont want to post too much here right now. I watched the video today, and it verified an almost unbelievable story my client told me. To make this real brief - my client was stopped. Tried to notify, but was told by one officer to shut up. Another officer came to the driver's side door, and again my client tried to notify. You can hear him in the video say "I've got . . ." before he his cut off with a profanity laced tirade, and demand for his driver's license. My clent hands the officer his license, tries to notify again while holding his CHL in his hand. The officer says "What? What are you waving around that you want me to see?" He takes it, looks at it, while my client says "I'm trying to tell you . . ." The officer asks, "do you have a gun? My guy says "Yes" and then is pushed against his vehicle while the officer takes the gun from my client's waistband holster. The total time from the officer approaching the car door to being told he has a gun was 55 seconds. It gets worse from there. The officer tells my guy that "I should blast you right in the mouth." "I'm close to caving in your head." "You are a stupid human being." "How would you like it if I pull mine and stick it to your head." When speaking to another officer, he says "I hate these ***** with their gd permits." And, again, later tells my client "I should have taken 2 steps back, put 10 rounds in your ***, and left you lying there. I should have executed you, and I'd go home and sleep good tonight." Internal affairs was notified. I am having a difficult time conveying the intensity involved. This was bad, really bad scene. Sorry I can't say more right now. Be careful out there!! Edit to add one more bit of information. My client was stopped in his motor vehicle at the time. He was in a no parking zone. There are bad apples in every profession, but the difference in Law Enforcement, is that they protect guys like this.
He's a "Brother". He's a part of the Thin Blue Line. Hopefully, this guy has managed to get himself recorded doing something that will get him fired. People get fired for the slightest infraction in the real world. And yet, somehow, getting rid of an asshole like that takes an act of Congress.

This is simple. If true, the officer should lose his job (and possibly face criminal charges). If not true, we should over react and demand the officer be fired with complete disregard for facts.

All true folks. The case is actually about a month old. I've been
waiting to verify what I was told before posting anything, because I had
a hard time believing it too. But, I watched it all. At the first
pretrial, the prosecutor offered to dismiss all charges for a release of
liability (promise they wouldnt be sued). I refused their offer. My
guy is a mild-mannered 50 some year old man, not some younger mouthy
stud. Sounds like that officer is going to be in some deep, deep shit. MORE: Say the department fires him for his actions. Assuming he is
represented by the FOP or a bargaining unit, he'll have his job back in 6
months. And if OFCC uses that in part of their case against the
department they lose some bargaining chip. The department will fire him
to please OFCC knowing it won't be a fire that will hold up. Therefore
OFCC would need to get a judge to order the firing AND prohibit him
from being a police officer in any state. What are the chances of that
happening on something like this? My guess would be slim to none.
There's a Cincinnati Police Officer still on the streets today that is
taser happy. CPD has successfully been sued 3 times in federal court
for him tasing people he shouldn't. He has been fired on all 3
occasions and on all 3 the FOP has gotten him hired back. Firing is
what we would all like to see, but in reality it's not very likely. Cities also don't care about being sued. I would say every city (even the small ones) have at least one lawsuit going on at all times. Every police department probably has one every year. They finish the one up, and a new one starts. It rarely ever hurst the city. It hurts the employee and the community of said municipality. Something like this one has to think big. This is the bargaining chip OFCC needs though IMO to get the notification law changed. They can show a clear case of a subject trying to notify, being told to shut up by the officers, and then being arrested for failure to notify and menaced in the process. And I know from reading on here there's plenty more cases like this, without the officer berating the subject though. What would be a royal slap in the face though would be if OFCC could get notification removed and somehow get it passed so all past cases are sealed, like what happened with SB17. |

What's the first thing an attorney tells you when he/she takes your case? Don't talk about your case... To anyone. So I have a hard time believing that an attorney would post this type of info in a public forum. Perhaps in a private email to a colleague, but in this case I will remain skeptical until veracity of the claim is confirmed with proof.

Yeah, I'm hoisting the BS flag high on this one. First, while the heights of stupidity that humans can reach never ceases to amaze me, I just can't believe that a cop who knows he is being recorded, likely by his own dash-cam, would say such things despite his dislike of permitted carriers.
Second, I can't believe any lawyer worth a shit would post details of a pending case on the internet, especially a gun forum. |

Doing so would jeopardize the ability to protect those who fuck up the first time, or are corrupt and don't get caught, by losing the legitimacy necessary to extend them a presumptive veil of innocence. Of course, that's assuming a given institution's self-protective instincts can overcome the unassimilated, or plain idiots inside. Inner-city culture might change things. |

Cops have been caught on dashcam fucking somebody they pulled over, using racial epithets, and doing all manner of stupid shit that you would think no sane person would ever do on camera. Sometimes this is a result of having gotten away with it in the past due to poor oversight or nobody complaining. |
