WASHINGTON – Today, Oversight and Government Reform Committee Chairman Darrell Issa released the following statement on news of the impending resignation of Justice Department’s Criminal Division head, Assistant Attorney General Lanny Breuer:

“Lanny Breuer’s resignation is long overdue,” Chairman Issa said. “Breuer was at the heart of several critical failures in Operation Fast and Furious:  he knew about reckless tactics, failed to take seriously allegations that they were continuing, and only owned up to his failures once they were publicly exposed.

“The Inspector General’s report admonished Breuer for failing to inform the Deputy Attorney General or the Attorney General when he learned, in April 2010, that the reckless tactic of gunwalking was used in a prior operation.  Furthermore, several of Breuer’s top deputies authorized sensitive wiretap applications under Breuer’s authority that, according to the OIG report, contained stark, incontrovertible evidence of the exact same gunwalking tactic.  Had Breuer taken any action whatsoever, Fast and Furious would have ended eight months sooner than it did. This resignation paves the way for needed new leadership in the Criminal Division.”

With Breuer’s resignation, the three highest ranking DOJ officials whom the DOJ Inspector General criticized in his September 2012 report on Operation Fast and Furious – former Acting Deputy Attorney General Gary Grindler, Deputy Assistant Attorney General Jason Weinstein, and Breuer – have now left the Department in the wake of the report’s release.

Would be nice if they came across files containing the documents that Holder is withholding from the committee, and released those.

Might actually get some news coverage.

No but it would make good propaganda.

House, Holder may near deal on Fast and Furious contempt

"Accordingly, the parties believe that, in order to enable the parties to focus their efforts on settlement and avoid the potentially unnecessary expenditure of judicial resources, the hearing on the Motion to Dismiss should be rescheduled for the week of April 15, 2013."

More delays.

What's the deal?  Holder contempts more, and the house gets some free lube?

Forbes: Obama Orders Prosecution Of Fast And Furious Perpetrators (Sort Of)
Now that President Obama has issued an executive order to “maximize enforcement efforts to prevent gun violence and prosecute gun crime”, is Attorney General Eric Holder’s job safe? That action was number 13 of the 23 gun control mandates he signed in the emotional wake of the tragic Sandy Hook Elementary School massacre in Newton, Connecticut.

The Obama administration filed a motion on January 11th to indefinitely stop a lawsuit by the legal watchdog group Judicial Watch demanding enforcement of a June 22, 2012 Freedom of Information Act (FOIA) request. The FOIA seeks all documents relating to Operation Fast and Furious, and “specifically all records subject to the claim of executive privilege invoked by President Obama on or about June 20, 2012.”

As Judicial Watch President Tom Fitton observed, “It is beyond ironic that the Obama administration has initiated an anti-gun violence push as it is seeking to keep secret key documents about its very own Fast and Furious gun walking scandal.” The justification offered in asking the court to indefinitely delay the suit because of the ongoing lawsuit to obtain the same documents filed by the U.S. House of Representatives which President Obama is asserting executive privilege to withhold from Congress.

The obama admin just lost the recess-appointment lawsuit brought by Landmark Legal Foundation (Mark Levin) and others. As a result, HotAir.com wrote this article ...

A deal may be near in the Operation-Fast-and-Furious-related dispute that led the House of Representatives to cite Attorney General Eric Holder for contempt last year.

U.S. District Court Judge Amy Jackson was set to hold a key hearing next week in the lawsuit the House filed seeking to enforce its subpoena for records of how the Justice Department responded to Congressional inquiries about the Bureau of Alcohol, Tobacco, Firearms and Explosives gunrunning investigation that may have resulted in as many as 2000 weapons flowing to Mexican drug cartels.

However, both the Justice Department and the House asked Jackson Tuesday to put the scheduled hearing off for more than two months as the two sides try to work out a deal that could obviate the need for the lawsuit.

<snip>

Obama didn’t learn that lesson, and now he has allowed the precedent in the DC Circuit (where the federal government operates in a legal sense as well as an actual sense) that limits recess appointments to only vacancies that first occur during formal intersession Congressional recesses, which all but eliminates recess appointments at all.

Zero doesn't like to lose. Seems he might be more reluctant now to let the courts decide the outcome for the holder contempt charges.

I do not see this delay as a positive thing for us

The ATF just seems to be trying as hard as they can to shoot themselves in the foot. Check out this new story out of Milwaukee.

A store calling itself Fearless Distributing opened early last year on an out-of-the-way street in Milwaukee's Riverwest neighborhood, offering designer clothes, athletic shoes, jewelry and drug paraphernalia

They were undercover agents from the U.S. Bureau of Alcohol, Tobacco, Firearms and Explosives running a storefront sting aimed at busting criminal operations in the city by purchasing drugs and guns from felons.

But the effort to date has not snared any major dealers or taken down a gang. Instead, it resulted in a string of mistakes and failures, including an ATF military-style machine gun landing on the streets of Milwaukee and the agency having $35,000 in merchandise stolen from its store, a Journal Sentinel investigation has found.

When the 10-month operation was shut down after the burglary, agents and Milwaukee police officers who participated in the sting cleared out the store but left behind a sensitive document that listed names, vehicles and phone numbers of undercover agents.

And the agency remains locked in a battle with the building's owner, who says he is owed about $15,000 because of utility bills, holes in the walls, broken doors and damage from an overflowing toilet.

So DOJ has literally tens of thousands of known felons that filled out 4473 forms and were denied firearms purchases presumably committing a felony by lying on the form and going without prosecution, yet ATF a branch of DOJ spends all this time and money to make 30 arrests?

The term breach of fiduciary duty comes to mind.

"And to your point, Mr. Baker, regarding the lack of prosecutions on lying on Form 4473s, we simply don't have the time or manpower to prosecute everybody who lies on a form, that checks a wrong box, that answers a question inaccurately." Says Joe Biden.

Is everyone remembering to bring up this illegitimate White House's funneling of thousands of real assault weapons to Mexico in their conversations about freedom control?

I contacted Mike Lee's offices yesterday, and reminded them about Fast & Furious.  They haven't forgotten.

Everything is making sense to me now.  A lot of puzzle pieces have fallen into place, and I see what the picture is...

It's much worse than I thought.

Back to Mexico
The main question that kept bugging me was, what changed in Mexico in 2007, that kicked off this civil war there, leading to the deaths of 60,000+ souls?  It used to be a tourist attraction, and now it's a bloodbath.  We know that comrade Hussein has helped fuel that bloodbath, primarily through Foreign Military Sales in conjunction with Fast & Furious.

Mexican GDP is dependent upon illegal drugs, remittance payments from immigrant insurgents in the US, and energy.

The conclusion that I'm coming to is that the Triad Gangs from Hong Kong used the specialists at smuggling (primarily MS-13), as well as other business fronts, to siphon out hundreds of billions in US cash (that is normally laundered through Mexico and the Caribbean region) into Chinese holdings.  This most bold financial blow in world history accomplished & resulted in several dynamics:

* It triggered the credit crisis of 2007-2008, because US banks no longer had cash in the vaults to back loans
* This credit crisis triggered the housing bubble to burst, and the resulting global economic crisis
* This pushed the banks to run to the Federal Reserve begging to print $787 billion for them to get liquidity back into the market (TARP)
* It left the Mexican cartels empty-handed, ripe for being turned against each other (El Gapo, I heard that Enrique jacked your cash...)
* The cartels responded accordingly

* It also gave the hidden hand an opportunity to agitate the useful idiots in DOJ to seize the moment with a false flag for a massive new gun-control scheme
* Since they have a puppet in the White House, his campaign paid for with illegal foreign money, what better opportunity than now...

An Inconvenient Series of Events
In that light, this regime encountered Brian Terry's and agent Zapata's deaths as inconvenient canaries that alerted us to an important component in this prematurely-signaled international web.  Everything was done in an attempt to hide the WH connection to Fast & Furious, and portray it as a rogue ATF Phoenix initiative once critical escape velocity had been reached in the media regarding ATF weapons being found at the scene.  The WH was forced into going on the defense & deny path, when the original plan was to use F&F deaths as a template for the gun control they are currently pushing for.  Who knows what type of "tragedy" on US soil they had planned with F&F weapons, but you get the sense of excitement when reading the DOJ emails after learning that they were used to kill Terry, although not what they were originally hoping for.

They let F&F fall out of the National Focus, after the series of delays and obfuscation with Holder and the Congressional hearings.  After the election, F&F seemed pointless for many career Republicans to "waste" political energy on, given the multiple brush fires started by the death by 1000 cuts strategy of this foreign-driven WH agenda.

With F&F effectively forgotten, they had freedom of maneuver to move forward with gun control, only needing the next SSRI-induced mass shooting or three to get the ball rolling back on track.  I called it years ago when I said they would wheel Gabriella Giffords out onto the Congressional floor, in an emotional cry to ban what little we have left of the 2A.

I didn't expect there to be as much resistance from the people and even Congress to a new Federal AWB though.  A lot of people have woken up, and that was apparent when I watched the Connecticut hearings on 70 new gun control proposals, while we get to guess what's behind all these redacted sections:

De-fund and disband that agency. They are an embarrassment and liability. They lie, cheat, steal and murder with seeming immunity.

I hope and pray the Reese family is "made whole" for ALL their losses.

See, it's not even about being "made whole." It's about punishing the wrong doers, and punishing them severely.  Because if its just the "government" paying a settlement, the perpetrators don't have any skin in the game.   I think the US attys have culpability in this case too.  They withheld evidence.  At a minimum, he should be disbarred.

What would have happened to the defendants attorney if they had withheld evidence?

25% for each question not answered expediently, 50% for every question unanswered, 75% per question answered dishonestly?

He should face the exact same sentences he put them up for.

IE, if he was looking for a total of 20 years, he should also be looking at 20 years if convicted of withholding the evidence that overturned their conviction.

Didn't the same thing happen with the case about the Oly AR-15 that malfunctioned and 'went auto' on a public range?  The defense didn't know (until after the trial) that the BATF lab's report said the rifle was not capable of firing multiple shots from a single trigger pull, until the lead agent had them redo the tests using ammo with improperly seated primers (which can cause slamfires).

That would be fantastic!  Perhaps I'd get a refund this year!

I'm assuming you're talking about the David Olofson case?

I remember all of the rest, except the part about an ATF lab report stating what the rest of us in that thread already knew/suspected.

Len Savage is in this thread, too, IIRC... but I doubt he checks it on a regular basis.

As I recall, the BATF lab tested the rifle, and reported that they could not get it to fire more than one round with a single pull of the trigger.  Then the lab repeated their previous tests, and reported  that the rifle would fire more than one round with a single pull of the trigger.  The defense learned that the rifle had been tested twice (and determined not to be a machinegun after the first test) after the trial.  Somewhere along the way, it came out that the lead agent had requested that the test be done again, and gave instructions on the ammo that was to be used.

If my memory isn't off.

If you read back a few pages, you can catch up on the last series of deaths in November of 2012 where several deaths had F&F weapons at the scene, to include a Mexican beauty queen.  One of the pistols found was an FN Five Seven bought and sold by ATF Assistant Special Agent of the ATF Phoenix Office, George Gillett, who was a manager there when Fast & Furious was launched.

Totally forgot about those, remember now.

I suppose Gillett still hasn't been prosecuted either.

Hopefully, there will be a new trial or not; there's been so much publicity in the local area and so much misconduct by the prosecution and .gov that .gov may decide not to prosecute again and allow the Reese family to put this behind them and reconstruct what's left of their lives and move on.

Hopefully, as Nolo reminded us, there will be retributions heaped upon the prosecution and judges who perpetrated this grave injustice.

They were convicted on a handful of lesser charges of making false statements on forms, basically under the presumption that they should have know federal agents were lying

I still say those prosecutors who knew they were lying should face the same sentences they tried to get them to serve.
