the person who killed the thief is not guilty of murder.  But if it happens in daylight, the one who killed the thief is guilty of murder.  Exodus 22: 2-3

Defense is only justified during sundown?

Incorrect. Defense is justifiable. Looting alone, during the day, would not constitute death if one's life was not threatened; however, they would owe the person restitution for doing so, and if they had nothing they were to be sold into slavery for their theft.

Hmmm...you'd think someone knew what He was doing when He made that law.  Good thing Man is smarter than that and made better laws....that's why we don't have much crime today.

God didn't say why, he left that to the priesthood to ponder.


The best reason I heard was that at night everybody can be presumed to be in the home and a stranger in the house in the dark can be presumed to be there to hurt somebody. The owner does not have to prove that that the thief intended to hurt somebody.

In contrast, during the day the family is 1) likely to be out of the home and 2) it is easier to discern what the thief's intent is.

There were no jails in the Mosaic law.
