Incorrect. Defense is justifiable. Looting alone, during the day, would not constitute death if one's life was not threatened; however, they would owe the person restitution for doing so, and if they had nothing they were to be sold into slavery for their theft.

God didn't say why, he left that to the priesthood to ponder.
The best reason I heard was that at night everybody can be presumed to be in the home and a stranger in the house in the dark can be presumed to be there to hurt somebody. The owner does not have to prove that that the thief intended to hurt somebody. In contrast, during the day the family is 1) likely to be out of the home and 2) it is easier to discern what the thief's intent is. |
