A lot of these accounts are pre-tax funds. There are no restrictions on where the spending works (as in, the cash register isn't going to refuse the sale) as you can buy a 2 liter of soda (which doesn't qualify) and some bandaids (which may qualify) in the same transaction at Wal-Greens.
Now, you've spent money using a trackable card, that you haven't been taxed for, and don't intend to pay tax on.
Whoops. That's where the catch is. It may not catch up to you at all, or it may not happen for a couple of years. But, are you going to bet the same IRS that decided to go after non-profits based on political slant won't go after people buying firearms with pre-taxed and never will be taxed personal income?
