So my uncle who has a HPD friend says that they passed a new law in Hawaii that says any folding knife that can open with a spring is illegal which includes assisted opening knives such as Kiershaws, Benchmade, ZT, etc. Is there some new law that I don't know about because I just spent the last hour looking online but could not find anything. My uncles friend also said it use to be a city ordanance law but not its an actual state law if that means anything. It also carries a Class C felony if caught with one.

First time I'm hearing of this. Sucks for us if it's true though.

Going to be difficult for passing a new law without any public debate. Then again it is Hawaii politics for you guys, Ken Onion and the other knife guys are going to be pissed if there is a new and unfavoriable law on the books.

I just talk to my uncle who is also a HPD officer and he says that the law was always in place but that it usually not inforced even when they arrest criminals that have an assisted knife on their person. He says the way the law is worded its very vague. Without having seen the specific law I cant tell. If it says spring opening then would a assisted knife fall into to this since most of them have a bar that is in tension and not a spring. I am hoping that someone with more knowlage will chime in.

hawaii knife laws ban switchblades and butterfly knives. Assisted knives do not open in the way described in the law that prohibits the previous knives.

§134-52 Switchblade knives; prohibitions; penalty.
(a) Whoever knowingly manufactures, sells, transfers,
possesses, or transports in the State any switchblade
knife, being any knife having a blade which opens
automatically (1) by hand pressure applied to a button
or other device in the handle of the knife, or
(2) by operation of inertia, gravity, or both, shall be
guilty of a misdemeanor.

[§134-53] Butterfly knives; prohibitions; penalty.
(a) Whoever knowingly manufactures, sells, transfers,
possesses, or transports in the State any butterfly knife,
being a knife having a blade encased in a split handle that
manually unfolds with hand or wrist action with the
assistance of inertia, gravity or both, shall be guilty of
a misdemeanor.

assisted knives do not have a button type release or open by inertia or gravity.

So I am wondering if this is a misinterpretation of the law that is in place now and how its interpreted by each officer.

It is not at all uncommon for cops to be misinformed on the details of certain laws. They aren't carrying around law books with them all the time. The law below sounds pretty clear to me. Please ask them to inform their coworkers that they are wrong.

If you read closely the part about... a button or any device in the handle ... so I don't believe assisted opening knives fall under the definition of a switchblade. All my assisted opening knives are by pressure on the blade.
