 Gifting a Handgun to a Michigan Resident

I live in Texas and my parents live in Michigan. My mother has her carry permit so I gave her a Sig P232. However, my folks said it's illegal to take it back to Michigan because they didn't get a purchase permit first. Can't they get the permit when they get back? I'm not fimiliar with the laws in MI. How can I legally give her the pistol? Thanks!

If you already gave it to her I am not 100% sure. If not you can ship it to a local (to her) FFL dealer in MI who will take a shipment from a private individual. Then mom can get a purchase permit from her local police/sheriff and then pay the transfer fee and pick up the gun.

If you gave her the gun already and she has brought it back to MI, you might (and I stress might) find an FFL who is willing to take the gun on his books and then transfer it to her after she gets a permit. This might not be 100% legal, but I am not sure.

Any way you look at it, it must be transferred through an FFL dealer in MI.

eta: just read it again, if she has her carry permit that throws all kinds of monkey in the wrench because as a CPL holder you can legally possess and carry someone else's pistol. Not sure about the whole transporting it to MI and getting it registered.

Might want to call her local sheriff and get an answer.

No. The Federal Gun Control Act of 1968 generally prohibits the transportation into or receipt in the state where a person resides of a firearm obtained outside of that state. The transfer of the firearms would be lawful if your father-in-law sends the firearms via common carrier (such as UPS) to a licensed firearms dealer in Michigan. The Michigan firearms dealer can then transfer the firearms to you providing you meet all statutory requirements. If the firearm is a pistol, a License to Purchase or valid Concealed Pistol License is required.



Looks per Fed Law you will have to ship it to a local MI FFL and get it transferred to her. If you aren't familiar it can be upwards of $40 or more to ship it UPS because it has to go overnight.

Where in MI does your Mom live, so we can find you a cheap FFL for transfer fee.

They live in Hastings (Barry County).

if they are driving home you can give her the gift in person the "last time you were there."
do some more research in this forum. There was a thread here not too long ago where a guy who recently moved to Michigan would never have to register his Handguns according to recent updates to Michigan law.

I'm a little over an hour from Hastings. If you want to ship it to me I'll do a transfer for free. Should cost you under $40 to ship it UPS.

Would love to know where that thread is because you do have to register your handguns no matter what. The only difference is you no longer have to take them into the Sheriff's station anymore you just have to send in the paperwork.
