Md. Senate Approves Self-Defense Bill

The Maryland Senate has endorsed a measure that would protect people from lawsuits if they use deadly force to defend themselves at home or work in certain circumstances.

Senators voted 45-2 Monday in favor of the bill. The legislation says a person must "reasonably" believe the lethal force is necessary to fend off the attack. It also stipulates that the amount and nature of the force must be "reasonable."

Current law in Maryland says a person must not use deadly force unless they believe they are in danger of serious bodily injury.

The bill now moves to the House of Delegates for consideration.

No reason to believe that they won't. If O'Mouthy vetoes it, we have ample cause to go for an override.

Here is an update on SB 411 (Castle Doctrine) that I received from one of the many legislatures I have
been in phone and email contact with.

Dear Sir/Madam,

I would like to continue to thank you for your letters supporting Second Amendment related bills in the House of Delegates. As a courtesy to you I am sending this update on the current status of S.B. 411 regarding civil immunity in cases of defending home and property (also known as the Castle Doctrine). I am pleased to advise you that Senate Bill 411 (which passed by the Senate Chamber by a 45-2 vote) has been heard by the House Judiciary Committee and issued a Favorable Report with Amendments on the Second Reader.

There are three amendments to this bill; however, they do not change the intent of the bill and compromise to the concerns of several Members. The main amendment, Amendment NO. 2 states:

“(C) SUBSECTION (B) OF THIS SECTION DOES NOT APPY TO A PERSON WHO IS CONVICTED OF A CRIME OF VIOLENCE UNDER §14-101 OF THE CRIMINAL LAW ARTICLE, ASSAULT IN THE SECOND DEGREE, OR RECLESS ENDANGERMENT ARISING OUT OF THE CIRCUMSTANCES DESCRIBED IN SUBSECTION (B) OF THIS SECTION.”

S.B. 411 is only one step away from reaching the Governor’s desk. The Castle Doctrine has been a bill proposed in the House for the past few years, and for this bill to reach Second Reader before final passage is a milestone for Second Amendment Rights in Maryland.

This bill will be heard on the House Floor for Third Reader by the end of this current week. I am thrilled to see this bill so close to becoming law. With the passage of this bill Marylanders will finally have the right to fully protect their homes and businesses. I am proud to be a part of helping this bill reach this monumental step in our legislative process. I am also appreciative for your hard work putting this bill in the forefront and finally passed the Senate.

14-101 identifies crimes of violence. In no way does it describe being charged in an instance of self defense.

ETA: Notification from the NRA indicates:

Additionally, in the new Subsection D, the Committee replaced “Shall” with “May”, “The Court may award costs and reasonable attorney’s fees to a defendant who prevails in a defense under this section”.
