I'm going to be home on leave for a week and want to legally transfer an M1 Garand to my brother... How does it work?
Will the FFL dealer hold the rifle for a cool down period?

The rifle is a CMP M1 I bought as a thankyou to my brother for watching and maintaining my firearms for seven years while I'm stationed in Okinawa.

Because the M1 is a Curio and relic, you can give it to your brother, no problem at all.

Yep. Over 50 years old, no need to transfer. (If it's a longgun, handguns still need to go through a dealer)

awesome! thanks guys. I'm looking forward to some trigger time. I get a week to visit family thanks to a 3 day class... otherwise it'd cost me almost 1500$ for a ticket.

Here's the law that states 50+ year old long guns can be legally transfered without the use of a CA FFL.
Be advised that after 01-01-2014, it will no longer be legal to transfer 50+ year old long guns this way. :(

Penal Code 27965
(a) If all of the following requirements are satisfied, Section 27545 does not apply to the sale, loan, or transfer of a firearm:
(1) The sale, loan, or transfer is infrequent, as defined in Section 16730.
(2) The firearm is not a handgun.
(3) The firearm is a curio or relic manufactured at least 50 years prior to the current date but is not a replica, as defined in Section 478.11 of Title 27 of the Code of Federal Regulations, or its successor.
(b) This section shall remain in effect only until January 1, 2014, and as of that date is repealed, unless a later enacted statute, that is enacted before January 1, 2014, deletes or extends that date.

To add: I'm transferring an AR (legal) and the FFLsaid I need to have an FFL actually send it.

Is this how it is in Cali? I thought I could just send it private to the FFL?

That is the FFLS policy not the law.

I accept firearms from individuals all the time.
All I ever ask is they include a clear copy of their ID so I can properly log the firearm.

Most of the time, I get this no problem and all is smooth.. whatever you do do not send it through a UPS store without putting your information somewhere for the dealer to find it.
I have had guns show up in locked boxes with the paperwork inside.
