 FN FAL legal in California?

a good friend of mine is planning on moving from a free state (AZ) to behind the iron curtain here and asked me if he could legally bring his new FN FAL .308 with a 16inch barrel.i wasnt sure about the legality's so i figured id ask the hive.i know hed have to sell his 20rd mags but after that im not sure.

The mag release button would need to be adapted.

If the receiver is stamped "Fabrique National" and "FAL" then it is on the DOJ's list of assault weapons banned by maker and model.

A FAL with a non-Fabrique National receiver, a magazine lock, and 10 round mag does not meet the DOJ definition of assault weapon and is not banned.

By "new," do you mean DSA? That should be G2G if it has a bullet button and 10 round mags.

i couldnt tell you.hes lived in AZ the last 5-6 years and judt got a $54/hour job offer so he'll be moving back within the week and gave me a ring to make sure he was G2G with all his guns

Wow, at least several incorrect responses above.

If you don't know, don't guess. Felonies are not fun. The list if banned-by-name guns is at 12276PC, as well as 11 CCR 5495 and 11 CCR 5499.

Remember, changing 'features' or adding a BulletButton on a banned-by-name gun will NOT remove its prohibited AW status.


1. If the gun is marked "Fabrique Nationale" with a model of "FAL", "LAR", "FNC", "308 Match" or "Sporter" it's banned by name.
DO NOT BRING IT INTO CA. No modifications will make this rifle CA legal.

2. The Springfield Armory FAL clone known as an "SAR-48" is also banned by name, regardless of features and/or Bullet Button.

3. If the receiver is not marked as one of the above guns - for example, DSA, Imbel, etc. then it is not banned by name. It can
then be rendered CA legal before entering California!!! by adding a BulletButton-style maglock device and using a 10rd mag.

4. DO NOT BRING IN HICAP MAGS (those over 10rds) INTO CA.

* Unless they were possessed by the rifle's owner inside the state prior to 2000 (rare but it happens).

For the OP tell yor friend that nothing is worth giving up his ability to 11 bullets in a row.

Check out CalGuns.Org - they have a dozen or so folks selling California compliance parts.

I did the DIY mod about 10 years ago drilling/tapping a magazine release and running a set screw into that locks the magazine in place. Adding a stripper clip upper means you can load the weapon (mine's a ST58) as fast as changing a magazine.
