 General Trust Questions

I was hoping you guys could answer some questions I have concerning Trusts and whatnot.

I have Trust that was put together for me by a lawyer, it just a stack of papers detailing different things... I'm not one for legalese but the idea is that the stack of papers is the actual trust (just seems weird to me)? And I'm guessing I send in a copy of this trust to the ATF? Is it an issue if the notary that notarized my trust's commission expires? Like do I need to get this thing re-notarized? And what if you can't make out the seal in the copy of the trust, will they reject my form?

Thanks, and sorry if these are dumb questions, I just want to be sure before I do anything. Thanks!

1) Yes, you will send in the whole entire trust document, it seems silly but that is what they want, also the schedule A with something listed in it, it should be part of your paperwork, but many forget this important paperwork

2) The notary question? I have no idea, but since this stuff takes forever, I would error on the side of caution and get the copies your submitting re-notarized or maybe someone else will have a better idea on what you should do. The expired part shouldnt be a big deal, it was valid at the time of the signing, that is all that should matter, but once again, someone else might chime in.

Awesome, that begins to clear some things up for me... however, I don't have a "Schedule 4" per say but something similar listed as a "Schedule 'A'"... I'm guessing that's it? Anyways, thanks!

Do Not send in the trust!! Send a COPY of the trust. You don't need to notarize, certify or anything else to it, just send a copy of the whole thing and wait.

Well, yes. I shouldve have clarified. You never send original documents. Always copies.

As far as notarized..hmm, not sure about that. Once again, I would get it notarized, this makes your signature legal and all that.

I've never notarized a copy being sent to BATFE, and have never had an issue with approvals. Make a copy, cut the check send it in.

If your signature on the original is notarized then it should all be gravy. A notarized document does not become invalid after the date the notary's commission is set to expire. If that were the case then every legal document in existence would have to be re-notarized every five years.

Awesome, one last question... I was told that it'll be rejected if I write a personal check, is that true? Would it be better if I use a Money Order from the Post Office?

Where are you getting your info? WHO told you that. You really need to stop listening to them, they are morons.

75% send personal checks, 20% send Money orders, 5% send something via company check, cashier check, etc.

I send in personal checks because itll act a as tracker, ill know roughly when they got it and Ill know when it was cashed, if you send a money order, you have no idea when it got cashed or even if it got there.

I have always sent personal checks just because it works better for me. The Feds don't care who pays the tax as long as it gets paid and the check doesn't bounce. If you want to split red hairs the seller is responsable for the tax, but good luck with that! Really this isn't rocket science, make sure the forms are filled out correctly, put it in the mail, wait patiently. Simple.

Okay last question, do I need two copies of everything to send in?

1.)Two copies of my trust, while I keep the original
2.)Two Form 1's identically filled out
3.)I heard I also need two Certifications of Compliance?

Also, do I staple it all together in one large packet? Make two stacks? How'd you send it in?

Sorry again if these are brain dead questions, I just want to cover all my bases so that it won't get kicked back to me.

Two copies of Form 1
Only one copy of the trust and cert of compliance though.

Yes you keep the original trust. Just send them a photocopy.

With the above being said, do you also include the Trust Schedule A....I am assuming that I add the new suppressor (the one for which the form is being submitted) to the schedule, then send a copy of it also. My only issue is the schedule has my first purchased suppressor on it (already have stamp for it).......

Send the copy of the "Declaration of Trust" which includes schedule a,b,c, etc. It doesn't matter if you add the SBR, suppressor, etc to the schedule before sending it in or after you get your paperwork back.
