 Buying an out-of-state collection

Not sure if this is the place to ask, but let's say I'm working out a deal for an out-of-state collection of 60 firearms. Pistols, rifles and shotguns.

How do I go about this as an individual? I can use my friend's FFL to bring them into the state, but how do get them transferred to me in that quantity?

Don't 60 4473s made out to 1 individual trip the red flashing light at the local ATF office? What if I wanted to keep part of the collection, and sell the rest?
Leave them with the FFL until they sell?

Get my own FFL? Can I get an FFL geared to sell at gunshows?

1) More than 1 firearm can be put on a 4473.

2) I would not xfer on 4473 any firearms you already intent to sell. Let FFL sell them via consignment or whatever other deal you can work out.

1. Agree

2. Agree again. Buying a large collection than selling part of it off maybe considered dealing without a license by the BATFE. I don't think there is any set number of guns or dollar amount per year to qualify as "dealing without a license". It is pretty much open to BATFE interpretation, like most of the gun laws.

Agreed, if you are buying the collection just to sell parts of it. The BATF may consider that dealing.

Yeah, sounds like that is the way to go.

No amount of firearms on a 4473 will raise flags though?

Maybe... (good answer huh?)

If there is more than one handgun on the 4473, then your FFL will have to do a 3310 multi-handgun purchase form. The form would list each handgun by make, model, and SN and is faxed to BATFE.

Another scenario would be the BATFE does an inspection on your FFL at some later date and sees the amount of guns on the 4473. They may decide to contact you.

This is why I agree with RenegadeX. It is basic CYA.

The BATFE questions you about the amount and you can honestly say that the guns you did not want were sold thru consignment by your FFL. The other guns that you wanted to keep are in your possession. Say 3 years down the line your FFL is inspected and the BATFE calls on you, and you have sold or traded two of the guns you had intended to keep. Selling a few guns over a three year period would be very hard to call "dealing without a license".

We had a customer who bought several handguns from us in a four month period, and we had to do a 3310 form on him a few times. The BATFE called wanted his infomation off of the 4473. The customer later told us the BATFE was curious about the amount of handguns he had bought and wanted to see them. The customer told the agent that he would not allow them to see all of his guns without a warrant. However the customer told the BATFE agent that the agent could pick any 3 or 4 guns and the customer would show those guns to them to prove he still owned them. The BATFE was satisfied and that was it.
