 Is it ok to sell a pistol upper without a Class III?

I have a customer that wants me to sell an AR pistol upper on consignment. I only have an 01 license, can I carry this as a consignment sale? It's a 9" or so barrel. Any advice would be really appreciated!

I don't have an FFL, but you can sell the pistol upper with no problems. Just be kind and make sure the customer understands he must have a pistol lower or a registered SBR or registered MG to put it on.

A upper iust just a part in the ATF's eyes. You don't even need an FFL to sell on upper.

But you should inform buyers that it can only be used on a pistol, SBR or MG.

What he is worried about is he probably also has complete lowers and having a 9 inch upper in the same vicinity makes it an SBR.

I am pretty sure though as an FFL it is not assumed you will assemble it.
