Ok i will be building a amd 65 pistol. I know the law states no front pistol grip, I also see a letter from the Feds saying the front pg and hand guard are considered one unit( meaning a handguard). So can I leave the hand guard on, or do I have to use a regular Ak guard?

Having the capability certain may be considered intent but apart from that you can have a rail on a pistol as evidence with so many auto pistols of today. So in answer to your question I would say as long as you aren't using that forend to mount a grip you should be perfectly fine.

As long as you remove the grip nut from the metal hand guard you will be good to go.
With the nut gone you can't mount a grip on it, but it may get a little hot it you rapidly shoot a mag or two.
