 AR-10 hi-cap magazines in New York State...

I'm finally doing an AR-10 build (I just have a stripped Armalite lower at the moment) and I'm trying to come to terms with the magazine issue since I live in NYS where we still have the AWB ban. I've been doing a lot of searches and reading and I just want to make sure I've got everything straight.

Essentially, I have to find pre-ban M14 hi-cap mags and either modify them myself, or buy the conversion kit from Armalite (I'm not too keen on converting them myself to be honest. I have a mill, but I don't want to burn through ammo doing function tests). The conversion kit seems to include everything but the spring and I assume should provide reliable operation. I read a statement from Armalite concerning the ATF's view on magazine conversions, basically saying that every part of a magazine can be replaced, just not all at once. All the replaced parts should be kept for proof of preban status (a somewhat nebulous thing in the first place in NYS for the most part...).

There's a gun show this weekend and I'm hoping to pick up the required M14 mags. USGI mags are pretty much the way to go, correct? I downloaded the M14 magazine identification guide (http://www.lulu.com/items/volume_70/10817000/10817809/2/print/Pictorial_M14_Magazine_Identification_Guide_Version_1.5_110614A.pdf), though I think it might be daunting to try to make a determination on the spot at the show.

If I do get a mag with a bum spring, I can still replace it at a later date and be okay considering what was stated above?

Is there anything I'm missing?

Also, I saw the sale on Armalite's site on the 10 round magazines. Do they do that often or should I jump on that now?

You may not manufacture a new magazine from a preban UNLESS it still functions perfectly fine in the gun it was originally intended for.

I have some of those modified magazines, some work, some don't, if i was buying a 308 in Ny i'd get the RRA that takes fal mags

That was the old federal law, no one knows what a NY court would say

"Under BATF guidance concerning provisions of the AWB, "Pre-ban” 20 shot M-14 magazines may be simply and legally converted to work in AR-10s with a magazine conversion kit from ArmaLite under the following restrictions:

1. The converted magazine must work in the rifle for which it was originally designed
2. All parts may be replaced with new parts, but not at one time."


Unless some new NYS legislation addressing repairing magazines has been passed, and so long as you retain the old magazine body as proof that you only "repaired" an existing preban 20rd M-14 mag, you could use the Armalite conversion kit since it comes with a replacement body, as well as a new follower and floorplate.

This is what I did while stationed in NY (2001-07), except that I used the very cheapest USA brand preban M-14 magazines that CTD sold at the time. Their only worth was their preban status. The springs, followers and floor plates eventually had to be replaced with USGI or better quality components... just not all at the same time.

I believe all you really need to do, is cut a mag catch hole in the M14 mag and slap it in the Armalite. It wont hold the bolt open, but I believe it works just fine.

Armalite says an unmodded M14 mag will work if you hold it in the mag well. With that said, I always assumed you could just cut a hole in the M14 mag, and have a magazine that works in 2 different 308s. I may be incorrect in that assumption, but thats what I got from all the Tech Notes regarding the mods.

Correct.

Basically, all you do is put a mag catch hole in side of the the M14 mag, and a notch in the mag body behind the follower (for the BHO plunger and you do have a magazine that works in 2 different 308s. My first gen AR-10 mags will work in both my AR-10 and my M1A (minus the BHO function).

+ On the RRA. Good FAL mags are more difficult to come by. Everytime I have been to the range and saw the RRA 308, it had a mag related jam. Mainly because the mags looked to be 30yrs old, but still. The RRA 308 is not that good because of the FAL mag.
