 Curiosity regarding sales of LEO/Mil only stuff

Okay so the coolest of cool stuff is LEO/Mil only. But I take it you can buy if you have a LEO/Mil ID? Or does the department itself have to purchase it?

Hypothetically speaking (honest cause I dont have 10G's to spend) if an LEO or soldier was to buy say some top of the line IR or Ballistic helmet and then decide they dont want it, could they legally sell it to a US citizen civilian?

Is it laws, manufacturer policy or TNVC policy that limits certain items to LEO/Mil purchase only?

Some of the gear marked LE/MIL only is our company policy while others fall under manufacturer policy, and yet some others fall under law. Standard Power IR lasers can only be sold to a department/unit/agency by law. They are governed by the FDA. Ballistic Helmet restrictions are our own because we are not a body armor dealer, yet helmets naturally dovetail with NV. But, different states have different laws regarding body armor sales to civies and, frankly, it is not our priority to stay abreast of these ever changing laws. So, we restrict it. The other restricted items are simply manufacturer policy that we must abide by to maintain our dealer/distributor status.

If an individual LEO or soldier buys something from us and then sells it to a civie, there is technically no law against it. But, some of the items (like IR lasers) live in a gray area that muddies the waters. Basically, the best I can tell you is that it is not illegal. But, I will not go so far as to say it is 100% legal. Some gear comes with an end user certificate that the buyer must sign that states they will turn it in to the manufacturer for disposal when they are done using it. By selling to someone instead, it is technically a breach of contract with the manufacturer. While not quite against the law, there can still be civil penalties for these actions.

Basically, I am not a lawyer, never played one on TV, nor did I stay in a Holiday Inn Express last night. So, I am not qualified to provide legal counsel on these matters. We follow the rules and expect our clients to do the same. We do not condone selling restricted gear to civies second hand in any way. Hope this answers your question.
