My G/F who is in college had her appendix removed to the tune of $30k. She was uninsured at the time and cannot afford the bills even after trying to negotiate them down(she really would like to pay and understands it is her debt however its not physically possible for her to swing the payments they are asking).

So long story short she moved in with me about 2 months ago. She talked with her lawyer today(who is either state or through the college) and he said it will be pretty quick and easy for her based of her financial figures.

The odd part is he asked about me and wants my personal financial info because she is living with me. Obviously this seems very strange since I dont have anything to do with it.

I guess how or why would they differentiate her whether she was my girlfriend or roommate or whatever. Just seems extremely odd I would have any reference to this at all.

So WTF is going on?

I don't do bankruptcy work, but that is truly odd. I see nothing on any of the bankruptcy schedules (the required forms for bankruptcy) that requires disclosure of such information by a person filing for bankruptcy.

Nope - not something I'd be willing to do.

She is a "roomer" and I am not giving out any info beyond what she pays to stay.

Thats what Im thinking too. Owning my own business and doing well for myself I see it as only trouble.

Ill have her clarify it with him to see what is going on. How or why they would care as to if she is living with me vs her sister or anything else is beyond me and then to disclose my personal finances for that "room mate" is truely odd

Nothing odd. Its standard practice in bankruptcy and has been for about six years now. In 2005, Congress "reformed" Bankruptcy law. Now a debtor in a Chapter 7 has to establish that they qualify for a Chapter 7 or be forced into a Chapter 13. Part of the process is showing that the household has less than the median income for a household of that size in your state. So even though she'd be declaring Chapter 7 only for herself, your income ( so long as you were a "household" ie., you share expenses ) is part of the petition. It won't affect your credit.

So non-married individuals who cohabitate count as a household? What, if any, is the distinction then between a household then and just a roommate?

The distinction currently varies a bit by where you are, since the circuits have not really settled the question.

Interesting..... and this is why I stay away from bankruptcy ......

If my client has a roommate, but they only sleep together when they are drunk, does that count?
